New York Misdemeanors & Felonies

While a conviction for a misdemeanor offense is not as severe compared to felonies, getting convicted of a misdemeanor can still lead to a lengthy jail sentence, expensive fines, and a criminal record that can follow you for the rest of your life.

Misdemeanor classes in New York include:

  • Class A misdemeanor – A conviction results in a jail term of up to one year and a maximum fine of $1,000

  • Class B misdemeanor – A conviction leads to a maximum jail sentence of three months and a fine no more than $500

On the other hand, a felony conviction is punishable by at least more than one year in prison and up to a life sentence. Not only does a felony carry harsh criminal penalties, but getting convicted could also result in the loss of gun rights, the loss of voting rights, and the losing eligibility for certain government benefits.

The following are the New York felony classes:

  • Class A-I felony – Punishable by life imprisonment (with a minimum term of 15 to 25 years)

  • Class A-II felony – Carries a life sentence (with a minimum term of three to eight years)

  • Class B felony – Punishably by imprisonment for up to 25 years (with a minimum term of one year or one-third of the maximum sentence)

  • Class C felony – Carries a maximum 15-year prison sentence (with a minimum term of one year and one-third of the maximum sentence)

  • Class D felony – Punishable by a maximum seven-year sentence (with a minimum term of one year and one-third of the maximum sentence)

  • Class E felony – Carries a maximum four-year sentence (with a minimum term of one year and one-third of the maximum sentence)
